The Seriousness Of Being Caught Driving After Suspension

New York has strict laws against driving after suspension. If you are caught driving while suspended, you may be charged with the crime of aggravated unlicensed operation of a motor vehicle.

Driving After Suspension In New York

Aggravated unlicensed operation is typically a misdemeanor offense, but may be charged as a felony in certain circumstances. The different types of aggravated unlicensed operation are set forth in New York’s Vehicle and Traffic Code at Article 20, Section 511. The three types of aggravated unlicensed operation include:

  • Aggravated unlicensed operation third degree: A misdemeanor with a maximum jail sentence of 30 days. This offense occurs when a person drives after the suspension (or revocation) of their driver’s license.
  • Aggravated unlicensed operation second degree: A misdemeanor with a maximum jail sentence of 180 days. This offense occurs when a person drives while suspended and has a prior conviction for aggravated unlicensed operation within the last 18 months.
  • Aggravated unlicensed operation first degree: A Class E felony offense. This occurs when a driver is caught driving on a suspended or revoked license while under the influence of alcohol or drugs.
